Farmer Must Honor Contract After Texting Thumbs-Up Emoji

Canadian famer Chris Achter has been ordered to pay the amount of $82,000 plus interests and costs for failing to deliver 86 metric ton of flax to South West Terminal, Ltd (SWT).

The commodity buyer said that after numerous phone conversations and later texting Achter an image of a signed contract to purchase flax at $17/bu, the farmer responded with a ‘thumbs-up’ emoji. Achter never delivered the flax and said that he never signed a contract. The King’s Bench for Saskatchewan ruled differently.
